1. Introduction

These Terms and Conditions (“Agreement”) govern the relationship between turnifure.com (“turnifure.com,” “we,” “us,” or “our”), represented by Javier Carrera, and the individual or entity using the ModMaker tool, subscribing to the Maker’s PASS service, purchasing Single Plan Credits, purchasing Static Plans, generating Free Plans, purchasing physical Ready-To-Assemble (RTA) furniture, or using services purchased under previous versions of this Agreement (“you” or “your”). By using the ModMaker tool, purchasing Credits, buying Static Plans, subscribing to Maker’s PASS, or purchasing physical furniture, you agree to be bound by this Agreement.

2. Plan Generation and Licensing

2.1 Accessing Plan Generation

Access to generate or acquire CNC-ready furniture plans (“Plans”) is obtained through one of the following methods:

• Free Plans: Unlimited generations of specific models designated as “free” in our catalog.
• Static Plans: Direct purchase of standard, pre-configured models without using the ModMaker customization tool.
• Per-Model Unlocks: A per-model purchase option to customize and generate variations of a specific plan for personal use using ModMaker for 1 year.
• Maker’s PASS (Per-Model): A subscription that unlocks unlimited generations for a specific model and provides a commercial manufacturing license.
• Legacy Maker’s PASS (All-Inclusive): A legacy subscription that unlocked all paid models with a commercial license (no longer available for new purchases).
• Legacy Unlocks: (For users with purchases prior to Nov 14, 2025, see Section 2.6).

2.2 Maker’s PASS Subscription License (Commercial)

Subject to the terms and conditions of this Agreement, turnifure.com grants you, during an active Maker’s PASS subscription period, a non-exclusive, non-transferable, revocable license to:

• Generate and Access Plans: Use the ModMaker tool to generate an unlimited number of Plans in both DXF and SVG formats for the specific model(s) covered by your Maker’s PASS. (For Legacy All-Inclusive Maker’s PASS holders, this applies to all paid designs available during your active 1-year subscription term).
• Download Plans: Download the generated Plans.
• Manufacture and Commercialize: Manufacture and commercialize the physical furniture products (“Products”) resulting from the Plans within your country or territory at the time of subscription, provided your Maker’s PASS subscription for that specific model remains active.

2.3 Per-Model Unlock License (Personal Use Only)

Subject to the purchase of a single model unlock, turnifure.com grants you access to generate variations of that specific design using the ModMaker tool for a period of one (1) year (365 days) from the purchase date.

• Manufacturing Rights: You may manufacture the physical furniture Product resulting from the files generated during your active unlock period.
• Strictly No Commercial Use: This license is for personal, end-user use only. You are strictly prohibited from selling, distributing, or commercializing the physical Product or the digital files. Commercial production requires an active Maker’s PASS.

2.4 Static Plans License (Personal Use Only)

Subject to the direct purchase of a Static Plan, turnifure.com grants you a non-exclusive, non-transferable, perpetual license regarding the specific pre-configured files purchased:

• Fulfillment: The specific DXF and SVG files matching the parameters of your purchase will be delivered directly to you via email.
• Manufacturing Rights: You may manufacture exactly one (1) physical unit of the furniture Product resulting from the purchased files.
• Strictly No Commercial Use: This license is for personal, end-user use only. You are strictly prohibited from selling, distributing, or commercializing the physical Product or the digital files.

2.5 Free Plans License (Personal Use Only)

For models designated as “Free” on the platform, turnifure.com grants you a non-exclusive, non-transferable, revocable license to:

• Generate Plans: Use the ModMaker tool to generate variations of the free model.
• Strictly No Commercial Use: Products manufactured from Free Plans are for personal, end-user use only. Commercial sale of the physical products or distribution of the digital files is strictly prohibited.

2.6 Legacy Plan Unlock and “Mods” License

This section applies only to ‘Plan Unlocks’ purchased prior to November 14, 2025. ‘Plan Unlocks’ and ‘Mods Packs’ are no longer available for purchase. Subject to the terms and conditions of this Agreement, upon purchasing a ‘Plan Unlock’ for a specific design, turnifure.com grants you a non-exclusive, non-transferable, revocable license to:

• Unlock Design Access: Gain access to the ModMaker tool for the specific purchased design for three hundred sixty-five (365) days from the date of purchase or last renewal.
• Generate and Access Plan: Use the ModMaker tool to generate the selected Plan, consuming one (1) ‘Mod’ from your account per generation.
• Personal or Commercial Use: Manufacture and assemble the resulting product (“Product”) for personal or commercial purposes, consistent with the intended use of the design, provided your Plan Unlock for that design remains active. Restrictions under Section 3 still apply.

3. License Restrictions

• No Transfer or Sharing: You agree not to share, transfer, sell, or distribute the generated
  Plans (DXF, SVG, or any other format) to any third party under any license tier. The license covers the physical manufacture of the object by you, not the redistribution of the digital file.
• Time Limitation (Maker’s PASS): The license granted under Section 2.2 is valid only for the duration of your active Maker’s PASS subscription period. Upon expiry, your right to generate new plans and commercialize products from previously generated plans ceases, unless renewed. You agree to unpublish and/or remove from public view or sale any Products for which the corresponding Maker’s PASS commercial license has lapsed.
• Geographical Limitation (Maker’s PASS Only): The commercial license granted under Section 2.2 is limited to the country or territory specified in your subscription.
• No Exclusivity: This Agreement does not grant you any exclusive rights to manufacture or commercialize the Products. turnifure.com may license the same Plans to other Makers in your region.
• No Impersonation or Misrepresentation: You agree not to impersonate turnifure.com, Javier Carrera, or sell the Products using the turnifure.com brand name. In all your marketing and sales materials, you must clearly identify turnifure.com as the designer of the Plans. You may use the following statement in your product descriptions: “Designed by turnifure.com. Manufactured by [Your Company Name].”
• No Modification: You may not modify, adapt, or create derivative works based on the digital Plans without the express written consent of turnifure.com, except for modifications inherent in the ModMaker tool’s functionality.

4. Purchases, Subscriptions, and Credits

4.1 Maker’s PASS Subscription

• Subscription Fee: The subscription fee for a Maker’s PASS is payable annually on a per-model basis.
• Renewal: To maintain access to unlimited Plan generation for your specific model via ModMaker and continue manufacturing and commercializing the Products under the Maker’s PASS license, you must renew your subscription for that model annually.
• Legacy All-Inclusive Maker’s PASS: Subscriptions purchased under the previous all-inclusive model will remain valid for one (1) year from their original purchase or renewal date. Upon expiration, the all-inclusive pass cannot be renewed, and commercial access must be obtained via the new per-model Maker’s PASS.

4.2 Per-Model Unlocks & Static Plans

• Purchases & Access: Per-Model Unlocks grant you unlimited generation access to customize a specific Plan via ModMaker for one (1) year (365 days) from the date of purchase. Static Plans bypass the ModMaker tool and are purchased directly and delivered via email.
• Expiration: Per-Model Unlocks expire exactly 365 days after the transaction is completed.
• Non-Refundable: Purchases of Per-Model Unlocks and Static Plans are non-refundable. It is your responsibility to verify the physical consistency of your dimensions and material thickness in the ModMaker preview before production.

4.3 Legacy Plan Unlocks and “Mods” System

This section applies only to purchases made prior to November 14, 2025.

• Usage & Validity: Plan Unlocks are valid for 365 days. Existing ‘Mods’ credits do not expire, but can only be used for designs for which you have an active, unexpired Plan Unlock.
• No Refunds: Money spent on purchasing Plan Unlocks or Mods Packs is non-refundable. Expired Plan Unlocks will not grant refunds for any unused included Mods.

5. ModMaker Usage & Fulfillment

• Fair Use and Rate Limiting: To ensure fair access and system stability, turnifure.com reserves the right to implement automated rate limits on plan generations (e.g., maximum generations per minute) across all tiers. We reserve the right to restrict or ban accounts utilizing bots or automated scripts to abuse the Free Plans tier or the ModMaker tool.
• No Plan Storage (ModMaker): turnifure.com does not store custom-generated Plans on its servers
  after generation via ModMaker. It is your sole responsibility to download and save both files (DXF and SVG) using the
  download links provided immediately after generation. You may re-generate files for unlocked models as many times as needed during your active 365-day access period.
• Static Plan Fulfillment: Static Plans bypass the ModMaker generation UI and are fulfilled autonomously via email to the address provided at checkout. It is your responsibility to ensure your email address is correct and capable of receiving file attachments.

6. Responsibility, Compliance, and Liability

• 3D Preview Consistency: It is your strict responsibility to thoroughly review the 3D preview of the assembled furniture within the ModMaker tool before generating or cutting production plans. ModMaker allows for a wide range of parametric adjustments; however, certain combinations of extreme input parameters may cause the resulting design to be physically inconsistent, structurally unsound, or impossible to assemble. turnifure.com is not liable for material waste, time loss, or any other damages resulting from the generation of inconsistent designs due to unchecked parameter inputs.
• Plan Verification: As the maker or user of the Plan, you are fully responsible for thoroughly checking the generated drawing (DXF, SVG, or any visual representation) for errors, omissions, or inaccuracies before any manufacturing process begins.
• Manufacturing Setup: You are solely responsible for correctly setting up the job, tooling, materials, and parameters for any manufacturing machine (CNC router, laser cutter, etc.) to ensure the machine accomplishes your intended outcome successfully and safely based on the generated Plan.
• Maker Responsibility & Compliance: As the purchaser of materials, manufacturer, and controller of the Product’s quality, you are solely responsible for ensuring full compliance with all applicable local regulations, safety standards, and industry best practices related to the manufacturing process and the final Product.
• Disclaimer of Estimations (Material, Path, and Yield): The ModMaker tool may provide estimations regarding required material, cutting paths, and material yield based on your selected plan configuration. These values are provided strictly as estimates and are completely devoid of any guarantee. Actual material usage, cutting time, and yield will vary depending on your specific machine, tooling, kerf, nesting software, and manufacturing processes. turnifure.com is not liable for any discrepancies between these estimates and your actual manufacturing outcomes.
• Disclaimer of Liability for Output: turnifure.com is not responsible in any manner for the outcome of any production resulting from the use of Plans generated via ModMaker. This includes, but is not limited to, errors in manufacturing, material waste, damage to equipment or tools, injuries to workers or end-users, or any other consequences arising from the manufacturing, assembly, or use of the Products. You assume all risks associated with the use of the generated Plans.
• Assembly Responsibility: You remain solely responsible for the safe and correct assembly of the Product, and for providing adequate instructions if required, even if you are providing the manufactured parts to a third party.

7. Custom RTA Furniture Purchases

As part of an ongoing market testing initiative, turnifure.com may offer custom-made, Ready-To-Assemble (RTA) physical furniture in specific designated markets. The following terms apply exclusively to the purchase of these physical goods:

• Fulfillment Scope: Unless explicitly stated otherwise on the specific product page at the time of purchase, RTA furniture purchases do not include assembly services or delivery to the final destination.
• No Returns: Due to the custom, made-to-order nature of these physical products, all sales are final. Returns, refunds, or exchanges are not accepted unless specifically noted on the product page at the time of checkout.

8. Multi-Designer Platform

turnifure.com operates as a multi-designer parametric marketplace hosting designs from both in-house and selected third-party creators. Revenue-sharing and designer payout programs are active for approved platform designers, with compensation calculated based on direct design sales and Maker’s PASS per-model unlocks. For each design unlock, turnifure.com charges a 25% transaction fee and a 3% + USD 1 payment processing fee. These fees are subject to change.

9. User Submissions and Content Suggestions

Any “Design Updates,” “Idea Drops,” feature suggestions, photos, renders, or content of any kind submitted to turnifure.com by designers or users do not imply any obligation on the part of turnifure.com to publish, broadcast, or promote them. All submissions are considered suggestions, and the decision to utilize, diffuse, or publish them rests entirely at the sole discretion of turnifure.com based on its operational convenience.
